Wedding Photography & Videography Terms & Conditions

These Terms & Conditions apply to all wedding photography and videography services provided by BigSmiles. (“we”, “us”, “our”) to the couple (“you”, “your”).

By booking our services, you agree to the following:

1. Booking & Payment

• A non-refundable booking fee Usually $200 is required to secure your wedding date.
• The remaining balance is due no later than 7 days before the wedding.
• Your booking is not confirmed until payment is received.

2. Cancellation by Couple

If you cancel:

• Booking fees are non-refundable.
• Cancellations within 7 days of the wedding may require full payment.
• If we rebook your date, we may offer partial refunds at our discretion.

3. Change of Date or Location

If you change your wedding date or location:

• We will make every effort to accommodate, subject to availability.
• If we are unavailable for the new date, it will be treated as a cancellation.
• Additional travel or accommodation costs may apply for location changes.

4. Coverage & Creative Style

• Our work reflects our creative style and professional judgement.
• Specific shots cannot be guaranteed due to time, weather, venue restrictions, or co-operation of guests.
• You accept that editing style, colour tones, and composition are artistic choices.
• If you have a particular style you like please let us know in advance of the day as some styles require taking photos in a distinct way for a style to work.

5. Weather & Uncontrollable Events

We are not responsible for missed or limited coverage caused by:

• Weather
• Late schedules
• Venue restrictions
• Guest interference
• Natural disasters
• Illness or emergencies
• Equipment failure beyond reasonable control

Every reasonable effort will be made to continue coverage where possible.
For peace of mind we do carry backup equipment at all times.

6. Substitution

If we are unable to attend due to serious illness or emergency, we reserve the right to provide a qualified replacement or refund payments received.

7. Delivery of Photos & Video

• Delivery timelines are typically up to 3 to 10 days.
• If your Wedding package includes a Hardcover Album this can take 4 to 6 weeks for editing and sizing for the book plus publishing and Delivery.
• Final images/videos are provided digitally unless otherwise agreed.
• Raw/unedited files are not supplied.

8. Copyright & Usage

• We retain copyright of all images and video.
• You receive full personal usage rights (printing, sharing, personal albums).
• Commercial use requires written permission.

We may use selected images/video for portfolio, website, social media, and marketing unless you request privacy in writing.

9. Client Cooperation

You agree to:

• Ensure access to venues and photo locations
• Obtain venue permissions where required
• Allow reasonable time for photography/video
• Inform guests that professional coverage is taking place

We are not responsible for missed moments due to guest obstruction or lack of cooperation.

10. Limitation of Liability

Our liability is limited to the amount paid under this agreement.

We are not liable for indirect losses, emotional distress, or consequential damages.

11. Insurance – Accidents, Loss & Personal Property

While we carry professional equipment insurance, we are **not responsible** for:

• Personal injury to guests or couples
• Damage to venues or property
• Lost or stolen personal items
• Accidents occurring during the wedding day

You are encouraged to hold your own wedding or event insurance.

12. Force Majeure

We are not liable for failure to perform due to events beyond our control including (but not limited to): acts of God, government restrictions, pandemics, extreme weather, or emergencies.

13. Agreement

By paying your booking fee (Deposit), you confirm you have read, understood, and agreed to these Terms & Conditions.
